A registration lasts ten years and then it must be renewed or it lapses. We file within the statutory window and remind you well in advance.
A Mexican registration lasts ten years counted from the date it was granted, not from the date it was filed (article 178 of the Mexican Industrial Property Law). That distinction matters, because people who diary the filing date renew late.
The renewal is requested within the six months before the registration expires. If that window closes, the Institute still admits the request during the six months that follow expiry. Once that grace period runs out the registration lapses by operation of law (articles 237 and 238). There is no discretionary extension after that, and no argument to make: the mark returns to the pool and anyone may apply for it.
Renewing is not only a payment. The renewal has to square with the declaration of real and effective use, and protection continues only for the goods or services on which use was actually declared (article 233). A registration renewed for a list far wider than what the business sells is a registration that invites a cancellation action from a competitor.
So before renewing we check what the mark is genuinely being used for, whether the list should be trimmed, and whether the business has moved into goods or services that are not covered and need a fresh application.
If you are not sure when your registration was granted, send us the registration number and we will confirm the date and the deadline.
