We combine legal rigor and commercial judgment in every intellectual property and corporate matter.
What usually goes wrong
Most trademark problems in Mexico are not lost arguments. They are deadlines that passed and decisions taken before anyone read the law. These are the four we see most often.
The wrong Nice class
One application covers one class, and enforcement reaches only what was actually registered. Correcting it later is not an amendment: modifying the mark or adding goods or services makes it a new filing, with a new fee and a new filing date (article 227 of the Mexican Industrial Property Law). The class is the cheapest decision to get right and the most expensive to fix.
Filing before searching
Four out of every ten marks that reach us cannot be registered as they stand. IMPI refuses on grounds set out in article 173, usually likelihood of confusion or lack of distinctiveness, and the official fee is not refunded. The search costs nothing here; the refusal costs the fee and the months.
Nobody watching the Gazette
A notification takes legal effect on publication in the Industrial Property Gazette alone, whether or not the courtesy email arrives (article 20). From there you have two months to respond, plus two more on payment of the corresponding fee (articles 225 and 226). Let both pass and the application is abandoned, with nothing to appeal.
The use declaration nobody calendars
Within the three months following the third anniversary of the grant, the owner must declare real and effective use (article 233). Two things surprise people: protection continues only for the goods or services actually declared, and if nothing is filed the registration lapses by operation of law, with no declaration from IMPI required. We track the date; you do not have to.
How we work
IMPI trademark specialists
We handle the online filing and the legal defense of your rights, from the availability search to the registration certificate.
Strategic Nice classification
Choosing the wrong class is the mistake nobody notices until they need to enforce. We classify for what your business actually does.
Protection for innovation
Patents, utility models and industrial designs, assessed before you disclose anything publicly.
Copyright before Indautor
Registration of literary, artistic and audiovisual works, and of software, with the agreements that assign the rights properly.
Trademark maintenance
Declarations of actual use and renewals tracked on our calendar. You get the reminder before the deadline, not after.
Active enforcement
Actions against counterfeiting, piracy and unfair competition, including border measures and platform takedowns.
Corporate solutions
Incorporation, amendments and corporate structure, with the intellectual property held by the company that operates it.
Cross-border work
Foreign investment, Madrid Protocol filings and coordination with counsel abroad. We work in English and Spanish.
Direct contact
You speak to the attorney who signs your file. No account managers, no handoffs, reply in under 24 business hours.
What you get in writing
Every stage leaves a document you can keep, forward or rely on later. Nothing important is communicated only by phone.
A registrability opinion naming each conflicting mark we found, with a rating per conflict and a recommendation.
A check of whether the blocking registrations are still alive or have already lapsed for want of a use declaration.
The application exactly as filed, with its file number and the Gazette reference.
A calendar of every statutory date on the file, including the use declaration and the renewal, with notice in advance.
Reasoned responses to office actions, citing the ground and the article relied on.
The registration certificate issued in the owner’s name.
Who we work with
Founders and growing businesses
Usually at the point where the brand starts to be worth copying: a new product line, a franchise, a round of investment, or a first imitator.
Foreign companies entering Mexico
You do not need a Mexican company to own a Mexican registration. You need a local address for service, which we provide as your representatives, and a power of attorney.
Four out of every ten marks that reach us cannot be registered as they stand. Send us the name and we come back with a straight answer on whether it has an obvious problem. No cost, no commitment. Need the full analysis, signed and in writing? That is the registrability opinion: USD 49 per mark and class, credited against your fees if you then file with us.
